Types Of Work Visa

The Australian government devised the General Skilled Migration program (Skillselect) in 2013 to replace the Australia skilled worker visas.

The Skillselect is designed to assess the skills of applicants under a point-based system so that immigrants with the right skills can be selected. The applicants are given points under the following criteria:

Age: Those between the ages of 25 and 32 score the most points while those above 45 do not gain any points.

English language proficiency: Applicants are required to take the IELTS test.  If they score 8 bands or more, you get 20 points.

Skilled employment: If you have experience in an occupation that is listed in the Skilled Occupations List you will get points based on the years of experience. 20 is the maximum points you can gain.

Educational qualification: To get points under this category, your qualification must be related to your nominated occupation. 20 points is the maximum you can score if you have a doctorate while a bachelor’s or master’s degree will give you 15 points.

Australian qualifications: You can get five points if you have an Australian qualification from an Australian educational institute.

Regional study: You can gain an additional 5 points if you have lived and studied in regional Australia.

Community language skills: You will gain another 5 points if you have translator/ interpreter level skills in one of the country’s communities languages.

Spouse/partner skills and qualifications: If you have included your spouse/partner in the application and he/she is not an Australian resident/citizen, then their skills are eligible to be counted towards your total points. You will gain an additional five points if your spouse/partner must meet the basic requirements of the Australian General Skilled Migration.

Professional year: You will stand to gain another 5 points if you have completed a Professional Year in Australia for a period of at least 12 months in the last four years from either ACS/CPA/CAANZ/IPA/Engineers Australia.  You must score a minimum of 65 points to qualify for a visa under the General Skilled Migrant Program.

Skilled Independent Visa: You can be eligible for this visa if you have the necessary skills and qualifications for specific occupations that are listed in the Skilled Occupation List (SOL). This visa does not require the sponsorship of an employer. You can use the SkillSelect tool to find out if your skills are in demand.

Employer Nomination Scheme: Under this scheme, a permanent work visa is given to workers sponsored by their companies.

TSS Visa (Temporary Skill Shortage): Under this visa, individuals can work between two to four years depending on the employee’s requirement. Applicants should have a minimum of two years’ work experience and should be below 45 years. Companies taking employees on this visa must pay them the market salary.

Permanent Work Visa Options

  • Employer Nomination Scheme (ENS) Visa – with this visa skilled workers nominated by their employer to live and work in the country permanently.
  • Regional Sponsored Migration Scheme (RSMS) Visa – Under this visa, skilled workers nominated by their employer in regional Australia to live and work in the country permanently.
  • Skilled Independent Visa –This visa is for invited workers and New Zealand citizens with skills Australia needs to live and work permanently anywhere in Australia
  • Skilled Nominated Visa –With this visa, nominated skilled workers can live and work in Australia as permanent residents.
  • Distinguished Talent Visa- This is a permanent visa for individuals with a globally recognized record of exceptional achievement in a profession, sport, the arts, or academics and research.

Temporary Work Visa Options

  • TSS visa (Temporary Skill Shortage):  Individuals can work between two to four years under this visa, depending on the requirement of the employee. To obtain this visa, Australian businesses would have to show they are facing a shortage of local talent for the job. Applicants should have previous work experience of at least two years and should be under 45 years.
  • Skilled Regional (Provisional) visa –This is a temporary visa for skilled workers who want to live and work in regional Australia.
  • Temporary Work (Short Stay Specialist) visa – This visa is for short-term, highly-specialized work in the country.
  • Working holiday visa: This visa is available to people in the 18-30 age group to enable them to take up short-term jobs in Australia while on a holiday. The validity period is twelve months.

Skill assessment

Skill assessment is integral to the work visa application process. One must select an occupation which is listed in the Australia’s Occupational Demand List. This list will mention occupations that face a skill shortage in the country. Every occupation in the list has its own skill assessing authority. The ACS (Australian Computer Society) assesses occupations under IT and computers. Trade occupations are assessed by the TRA (Trade Recognition Australia) or the VETASSESS (Vocational Educational and Training Assessment Services).

If an applicant must move to the next stage of the visa application process, he must get a positive skill assessment.

To get their skill assessment done candidates must meet the required conditions outlined by the assessing authority which is evaluating their occupation. The candidate should have the related qualifications and experience to get a positive assessment.

The first requirement for a positive skill assessment is that your occupation must be related to your work experience. If there is a mismatch, then you will not get the required points.

AUSTRALIA GRADUATE TEMPORARY VISA PROGRAM DETAILS :

The Graduate Temporary Visa is a temporary visa awarded to students that allows successful applicants to live and work in Australia for up 18 months to 4 years. There are two major types of visas issued under this program:
Choose the one most appropriate for them. These subclasses are:

  • Graduate Work Visa – For students who have completed 2 years Australia education in the last 6 months before applying for this visa and have applied for skill assessment in the nominated occupation on the Skilled Occupations List.
  • Graduate Post-Study Visa – For students who have competed for a bachelor’s degree or higher. This visa looks primary at your educational credentials and does not require your occupation to be listed on the Skilled Occupations List

Under both these visa types you can live and work anywhere in Australia with your family, the study in Australia and travel in and out of Australia as long as your visa is valid. The visa duration typically lasts between 18 months to 4 years.

ELIGIBILITY FOR AUSTRALIA Graduate Temporary Visa PROGRAM :

The Australia Graduate Temporary (Subclass 485) Visa is focused on assessing the educational credentials of students. It is designed to retain talent in Australia and is a great route to settle permanently in Australia. The key eligibility criteria are:

  • Your age (should be between 18-50 years of age)
  • Australian educational credentials
  • Details of the 2 years or more spent studying in Australia
  • Your English language skills
  • Whether your occupation is on the Skilled Occupations List
  • Your work experience
  • Health and character assessment

AUSTRALIA SKILLED MIGRATION PROGRAM DETAILS :

The Skilled Migration Program invites professionals whose profession is listed on the Skilled Occupations List to lodge an Expression of Interest (EOI) in Skill select, which enables Australian immigration officials to evaluate your profile. There are varying subclasses under the Australia Skilled Migration Program and applicants must choose the one most appropriate for them. These subclasses are:

  • Skilled Independent Visa (subclass 189): A points-based visa for applicants who have not been nominated by an employer, state, territory or family member.
  • Skilled – Nominated (subclass 190) Visa: A points-based visa for applicants who have been nominated by an Australian state or territory. You can apply for this visa even though you may not be nominated by an employer. 

ELIGIBILITY Required :

    • Experience in a nominated occupation on Australia’s Skilled Occupations List
    • Get a skill assessment report by a designated authority for that occupation

    The Subclass 190 visa is for aspiring immigrants who have the skills and abilities that are in demand in specific states of the country. However, these aspirants might not have the required points to qualify for a skilled independent visa under the Skilled Migration program. The visa is for skilled experts and tradespeople who can be nominated by an Australian state or territory.

  • Skilled – Recognized Graduate Visa (subclass 476): With this visa, recent engineering graduates can work, live, or study in Australia for up to 18 months. Applicants should have completed an engineering course from a specific institution within the past 2 years. The applicant should be under 31 years of age.
  • Graduate Temporary (Subclass 485) Visa: A visa for migrant students who have completed at least 2 years of study in Australia in the last 6 months
  • Skilled – Nominated or Sponsored Provisional (Subclass 491) Visa: A points-based visa for applicants who are nominated by an Australian state or territory, or by a relative living in regional areas (i.e., except Sydney, Melbourne, and Brisbane, rest all considered as regional cities or areas), to live and work in regional areas. The applicant can move between regional areas. It is a temporary visa valid for 5 years and can be converted to PR after working for 3 years with a minimum threshold salary of AUD53,900 p.a. Applications of 491 subclasses are eligible for priority processing.
  • Skilled Regional (Subclass 887) Visa: A permanent visa for migrants who currently hold other applicable visas

AUSTRALIA TEMPORARY SKILLS SHORTAGE (TSS) VISA (SUB CLASS 482) :

This visa allows a skilled worker travel into Australia to work in his/her nominated occupation for that person’s approved sponsor (employer) for up to four years.

Before an employee can apply for a Subclass 482 visa, he /she should have an employer who is a standard business sponsor and also must have applied for a nomination with the Department of Home Affairs(DHA) for the sponsoring applicant.

Employers who already known (standard business sponsor) can file for the nomination of the employee and once the nomination is approved, the applicant will have to lodge the visa application within 6 months.

Employers, who are not eligible sponsors, should apply to become one first and then file for employee nominations. Sponsorship and Nomination applications can also be made simultaneously.

There are many obligations for an employer to become a business sponsor and to nominate an employee. Employer is required to meet the requirements set by the department of immigration for an eligible sponsor based on the business tenure, critical requirement of positions, training benchmarks, if they have checked that there are no Australian citizens /PR holders available to occupy these positions, the salary being offered to the nominating employee and many other requirements.

THE VARIOUS STREAMS UNDER 482 SUB CLASS VISA
  • The Short-Term stream – 2 – 4 years, occupation should be in STSOL
  • The Medium-Term stream – Upto 4 years, occupation should be in MLTSSL
  • The Labour Agreement stream – Upto 4 year, as per the Labour Agreement

ELIGIBILITY FOR TEMPORARY SKILLS SHORTAGE VISA (TSS VISA) :

  • Have been sponsored by an approved standard business sponsor
  • Nominated under a skilled occupation that has been approved by the Australian Government
  • Have the required skills to fill a position nominated by an approved standard business sponsor
  • English requirements, Registration /License(if applicable)
  • Eligible to work only in the nominated occupation
  • Satisfy health, character and other skills requirements
  • Have adequate health insurance unless you are covered by Medicare
  • Can include your partner, dependent children and family members
